TERMS AND CONDITIONS OF AUCTION SALE
A $500 BIDDER DEPOSIT IS REQUIRED AT REGISTRATION. THIS DEPOSIT WILL BE APPLIED TO ANY PURCHASES THE BIDDER MAKES, BUT IS OTHERWISE FULLY REFUNDABLE.
A FURTHER DEPOSIT OF 25% OF THE SELLING PRICE WILL BE REQUIRED ON MAJOR ITEMS. ALL PURCHASES ARE TO BE PAID IN FULL BY FRIDAY, JANUARY 28 AT 12:00 NOON. ALL GOODS TO BE REMOVED BY 5 PM TUESDAY, FEBRUARY 1, UNLESS ARRANGED OTHERWISE WITH AUCTIONEERS. A 10% BUYERS PREMIUM WILL BE ADDED TO ALL PURCHASES.
All payments by way of cash, certified cheque or cheque with letter from bank guaranteeing payment. Visa and Mastercard payments will be accepted on the day of the Sale only. The auctioneer reserves the right to require payment by way of wire transfer for major items. You are encouraged to establish payment arrangements with the auctioneer prior to the day of the Sale.
1. All goods sold as is, where is. All sales will be final and there will be no exchanges, refunds or rebates. No warranty on the goods sold is given or implied by the auctioneer and/or his principals. The purchaser will be deemed to have relied entirely on his or her own inspections and investigations with respect to the description, suitability, merchantability, quality, quantity and condition of the goods sold. The auctioneer has the option of selling the goods individually, "en bloc" or in lots. The Sale is subject to deletions and additions. The goods offered do not necessarily belong to the same estate.
2. All sales are for cash, certified cheque, or cheque with letter from bank on which it is drawn guaranteeing payment. The auctioneer reserves the right to require a bank wire transfer for payment of certain items and/or to require payment in full during the Sale. Visa and Master Card will be accepted only on the day of the Sale. Purchases are payable as follows: a. 25% of the purchase price as a deposit at the time of purchase. b. The balance payable by 12:00 Noon on the day following the last day of the Sale. Goods may be removed only after presentation of an invoice marked "paid." All money received from a purchaser, whether by deposit or otherwise, may be retained by the auctioneer as liquidated damages, in the event that the purchaser fails to comply with these Terms. Lots not paid for and removed within the time allowed under these Terms of Sale may be resold without further notice. Any deficiency realized on such sale in excess of monies already paid will be paid to the auctioneer by the purchaser, together with any expenses incurred by reason of such sale.
3. Purchasers will pay Harmonized Sales Tax.
4. The auctioneer at his sole discretion may require any person or persons to leave the premises when the Sale is being conducted. All potential bidders must register and produce valid identification. The auctioneer may refuse to accept any bid from any person on any goods.
5. All bids are irrevocable. The auctioneer's decision on all disputes with respect to bids and purchases will be final and binding.
6. No goods will be removed until completion of the Sale. Removal of the goods is at the expense and responsibility of the purchaser. All goods are at the purchaser's risk once they are invoiced. The purchaser will be liable for any damages to the building caused as a result of handling of goods by the purchaser or his agents.
7. The auctioneer is acting as agent only and is not responsible for the actions of his principals. Neither the auctioneer, vendor, nor owner of the premises assumes any responsibility for injury of loss to person or property of those attending the Sale.
8. All bids are subject to the foregoing. The auctioneer, in his sole discretion, may waive any of the Terms of Sale.
